These Terms & Conditions ("Terms") govern your use of the Passpix application ("Passpix", "the App", "we", "us"). By downloading or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. The Service

Passpix is an AI photo studio. You provide a photo and the App uses artificial intelligence to produce an edited result, including ID/passport-style photos, professional headshots, portrait retouching, AI outfit changes, old-photo restoration, background cut-out and replacement, and high-resolution upscaling. The App also provides related library, export, and management features, supported by advertising and optional subscriptions.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) and able to form a binding contract to use the App. If you are a minor, you must have permission from a parent or legal guardian.

3. AI-Generated Content

• How it works: the photo you provide is sent to third-party AI services (including models hosted by Replicate, Inc., such as FLUX Kontext and Real-ESRGAN) which process the image and generate the edited result. We do not manually review every output.
• "As is": AI output is probabilistic. Edited photos may be imperfect, alter facial features or details, look unnatural, or differ from your expectations. An ID or passport-style photo generated by the App is not guaranteed to be accepted by any government agency, institution, or document authority; you are responsible for confirming that a photo meets the relevant official requirements before relying on it.
• Your inputs: you are solely responsible for the photos you upload. You represent that you have the right to use each photo and the consent of any identifiable person in it. You must not submit images that are unlawful, infringing, or that depict others without permission, and you must not create content that is defamatory, harassing, deceptive, or sexually explicit involving minors.
• Ownership and use of outputs: as between you and us, and to the extent permitted by the underlying AI providers' terms and applicable law, you may use the photos you generate for your personal, lawful purposes. You are responsible for ensuring your use of any output does not infringe third-party rights or misrepresent any person. We grant no exclusivity, as similar outputs may be generated for other users.

4. Acceptable Use

You agree not to:

• use the App for any unlawful purpose or in violation of these Terms;
• upload photos of other people without their consent, or use outputs to impersonate, deceive, or defraud;
• submit images intended to generate infringing, defamatory, or harmful content;
• attempt to reverse engineer, scrape, overload, or circumvent the App, its generation limits, or its security;
• resell or commercially exploit the service or generated content except as permitted above; or
• use the App in any way that could harm us, other users, or our service providers.

5. Subscriptions and Billing

• Passpix offers optional auto-renewing subscriptions on weekly, monthly, and yearly plans, which unlock the AI tools with an allowance of up to 30 generations per week.
• Prices are shown in the App in your local currency before purchase. Payment is charged to your Apple ID account upon confirmation.
• Auto-renewal: your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• Managing and cancelling: you can manage or cancel your subscription in your App Store account settings. Deleting the App does not cancel a subscription.
• Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription. Payments are non-refundable except where required by law or by Apple's policies.

6. Advertising

If you do not hold an active subscription, the App displays advertising provided by third parties. Your interaction with ads is governed by the advertisers' and ad networks' own terms and privacy practices.

7. Intellectual Property

The App, its software, branding, and design are owned by us or our licensors and are protected by intellectual property laws. Except for the rights expressly granted in these Terms, no rights are transferred to you.

8. Disclaimers

The App and all generated content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI output. We do not warrant that the App will be uninterrupted, secure, or error-free, or that any generated photo will satisfy a particular official document standard.

9. Limitation of Liability

To the maximum extent permitted by law, we and our service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the App or any generated content. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim, or USD 50, whichever is greater.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, and expenses arising out of the photos you upload, your use of generated content, or your violation of these Terms or the rights of others.

11. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or misuse the service. You may stop using the App at any time. Sections that by their nature should survive termination will continue to apply.

12. Apple App Store Terms

These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. To the extent permitted by law, Apple provides no warranty for the App, and any product warranty claims, claims of non-conformity, or third-party intellectual-property claims will be handled by us, not Apple. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list, and you agree to comply with applicable third-party terms (such as your carrier's data plan) when using the App.

13. Changes to These Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, where appropriate, notify you in the App. Continued use after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules, and subject to any mandatory consumer-protection rights available to you in your country of residence.
